A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a representative director of E Co., Ltd. (hereinafter referred to as “E”) established by D to efficiently carry out information and communications operation projects, such as C, and is a person who has overall control over the business affairs of the said E Co., Ltd. and managed personal information related to personnel management

F and G are Grade 2 employees who were employed in E through open recruitment on August 2015, and H are the deputy head in charge of personnel affairs of J (hereinafter “J”) a foundation established by I for the development of science and technology and technological innovation in the Do, who handle personal information related to the personnel affairs and employment of the said foundation in the course of business, and K is a person selected as the J president through open recruitment on October 2014 and served until October 2016.

On August 4, 2015, the Defendant sent, at the E office located on the 21st floor of LA building, a file containing personal information, such as the name, date of birth, academic background, school background, career, qualification matters, etc. of 11 members of M, etc., provided for the aforementioned disclosure recruitment, to assist in the employment of E in the F and G employment, from among the E office located on the 21st floor of LA, the Defendant sent the file of “regular employees” to the above F’s e-mail (N) and G e-mail (O).

Accordingly, the Defendant disclosed 11 personal information, such as M known to F and G in the course of performing his duties, as shown in the list 1 of attached crimes.

2. On October 7, 2014, at around 18:13, the Defendant committed a crime relating to the recruitment of the president of the JJ;

In order for K to deliver it to K with the knowledge that K has applied for the recruitment of the J president, the J personnel officer provided H with support for the recruitment of the J president.

The examination committee requests that the information on who has been supported and how the examination committee is composed shall change." 11 names, dates of birth, gender, educational background, place of residence, and major experience, such as P, etc. applied for the above open recruitment from H, shall be the list of applicants for the open recruitment of the president in which personal information is recorded.
