Purport of claim and appeal

The reasoning of this court's reasoning is that the defendant cannot take over the registration of transfer until the cancellation of the registration of seizure completed with respect to the motor vehicle of this case. However, there is no evidence to acknowledge that the defendant agreed to take over the registration of transfer of ownership by prior performance or simultaneous performance between the plaintiff or transferor and the plaintiff or the transferor. Since the plaintiff's obligation to cancel the registration of seizure and the obligation to take over the transfer of ownership can not be seen as having relation with the plaintiff's obligation to take over the transfer of ownership as a consideration, the above argument of the defendant is identical to the reasons of the judgment of the court of first instance except for adding "the defendant's assertion is without merit" as stated in the main sentence of Article 420 of the Civil Procedure Act.

Therefore, the judgment of the first instance court is legitimate, and the defendant's appeal is dismissed as it is without merit. It is so decided as per Disposition.
