1. The defendant shall make the plaintiff, ① all the fourth floor neighborhood living facilities of the building emitted from the attached list, and beauty art instructors.

Reasons

1. Determination on both arguments

A. On July 2018, the Defendant leased the part of the building (hereinafter “the building part of this case”) emitted from the Plaintiff’s order from the Plaintiff on July 1, 2018 to KRW 20 million monthly rent of KRW 20 million (per 300,000 won and value added tax each month), the lease term of KRW 10,000,000 from August 1, 2018 to July 31, 2020, and accordingly, the Plaintiff paid KRW 10,000,000 among the lease deposit and KRW 15,30,000 from the transfer of the building part of this case to the long time after the Plaintiff occupied and used the building part of this case, and there is no dispute between the parties to this case and KRW 25,000,000,000 in total,000,000,000,000 won (including value-added tax). According to these facts, the above lease relation of the building part of this case is sufficient to be paid to the Plaintiff.

나. 이에 대하여 피고는 별지(☞ 요약 쟁점정리서면)에 나오는 바와 같은 사정을 내세우면서 원고의 이 사건 각 청구가 모두 부당하다는 취지로 다투지만, 을 1-1~1-3의 각 일부 기재 또는 영상만으로는 이 점을 인정하기에 여전히 부족하고, 그밖에 이를 인정할 만한 증거가 없으므로, 피고가 내세우는 위 주장은 받아들일 수 없다.
