A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On February 8, 2013, the Defendant received a summary order of KRW 5 million from the Daegu District Court to a fine for a violation of the Road Traffic Act, and a summary order of KRW 3 million from the same court on December 4, 2013 to a fine for a violation of the Road Traffic Act.

(Criminal Facts)

1. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Doing Vehicles) and the Road Traffic Act (Non-accidenting Measures) are those who are engaged in driving service of XG cars.

On March 17, 2014, the Defendant driven the above car at around 18:30 on March 17, 2014, and led to a road of about 50 km in front of the Jindo, which is located in Pungdo-gun, in each south of the Cheongdo-gun.

At the same time, prior to the same direction, the victim D (n, 32 years old) followed the E SP car driven by the victim D, and thus, the person engaged in driving service had a duty of care to look at the situation and secure a safe distance to avoid when the said car stops.

Nevertheless, the Defendant neglected this and got off the part behind the above SP car driven by the said victim due to the negligence of driving excessively adjacent to the Defendant while under the influence of alcohol and received the part of the front part of the XG car.

As a result, the Defendant, by negligence in the above occupational negligence, sustained injury to the victim, such as scopical salt in need of treatment for about two weeks, and at the same time, destroyed the above scopic car to the extent of a sum of KRW 1,912,00,000, and escaped without taking necessary measures, such as stopping the vehicle and providing relief to the victim.

2. On March 17, 2014, the Defendant of the Road Traffic Act and the Road Traffic Act (driving without a license) are located within a section of about 7km from pure front road to the front road of the Defendant’s house located in Cheongdo-gun F, Cheongdo-gun, Cheongdo-gun, a pure front road, which is located in the wind angle of Cheongdo-gun, Cheongdo-gun, around 18:10.
