피고인은 2019. 8. 13. 23:00경부터 2019. 8. 14. 00:00경 사이 고양시 일산동구 중앙로 1270 정발산역 지하철(대화행, 3호선) 내에서 피해자 B가 시끄럽게 떠든다는 이유로 화가나 피해자가 앉아 있던 객석으로 다가가 주먹을 쥔 상태로 피해자에게 “니가 여기 전세 냈냐, 죽고 싶냐” 라고 말을 하였고, 이에 놀란 피해자가 그 자리를 회피하고자 다른 객차로 이동하려는데 계속 따라다니면서 “죽고 싶냐”며 마치 어떤 위해를 가할 듯한 행동을 계속 하는 등 해악을 고지하여 피해자로 하여금 겁에 질리게끔 하였다.

Accordingly, the defendant threatened the victim.
