A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The Defendant, who violated the Act on the Control of Narcotics, etc. (flag) is not a person handling narcotics, is prohibited from importing Metepha clopon (a single philopon; hereinafter “philopon”).

On June 16, 2020, the Defendant conspiredd to import philophones into the Republic of Korea, along with a name-free box (one name B) in Thailand (one name “B”).

피고인은 2020. 6. 17.경 불상지에서 자신의 친동생 C에게 위 성명불상자의 까씨껀 은행 계좌로 필로폰 매매대금 5,500바트(한화 약 210,000원)를 송금하도록 하고, 위 성명불상자는 2020. 6. 19.경 태국 이하 불상지에서 필로폰 4.22g을 비닐 지퍼백에 넣고 휴지와 은박지로 감싼 후 티셔츠 뒤쪽 상표택에 넣어 은닉한 다음, 수취인을 ‘D(E)', 수취지를 ‘경기도 구리시 F에 있는 G’로 기재하고 ㈜H 항공특송화물(B/L I)로 발송하여, 위 국제우편물이 2020. 6. 20. 19:05경 J편을 통해 인천국제공항에 도착하게 하고, 피고인은 2020. 6. 23. 12:50경 구리시 F에 있는 G에서 위 필로폰이 은닉된 국제우편물을 수령하였다.

Accordingly, the defendant imported 4.22 g of philophones into the Republic of Korea in collusion with the name influories of Thailand.

2. Any foreigner who violates the Immigration Control Act may sojourn in Korea within the limits of his/her sojourn status and period of sojourn.

Nevertheless, the Defendant, on November 6, 2019, entered the Republic of Korea through the Kimhae Airport as a foreigner of Thailand nationality, and was staying in the Republic of Korea until June 23, 2020 without departing from Korea despite the expiration of the period of stay as of February 4, 2020.
