A. The Plaintiff is a child rearing facility under Article 52(1)1 of the Child Welfare Act and a social welfare foundation that establishes and operates “A”, which is a social welfare facility under Article 34(4) of the Social Welfare Services Act (hereinafter “instant welfare facility”).

B. On April 2017, the Defendant issued an order to return subsidies (hereinafter “instant order to return subsidies”) and an order to improve the facility (hereinafter “order to improve the facility of this case”) to the Plaintiff on July 7, 2017, on the grounds as follows: (a) the Defendant issued a guidance and inspection on the instant welfare facility; and (b) each of the above dispositions was referred to as “instant disposition”).
