A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

The Defendant, on January 2017, 2017, 2814, received money from the injured party who was faced with economic difficulties due to lack of living expenses, but did not have intent or ability to sell goods or to provide services, thereby deceiving many unspecified victims of money.

1. On January 3, 2017, the Defendant reported on the following: (a) around January 3, 2017, around Kimhae-si, that “A request the production of a shopping mall website” posted by the victim E to the “D” at the Defendant’s residence located in Kimhae-si; (b) made contact to the victim and deposited KRW 550,000 won on deposit with the victim; and (c) made a website up until January 12, 2017 on deposit with the victim.

On the same day, 550,000 won was remitted to the national bank account (F) in the name of the defendant from the damaged person.

2. On April 17, 2017, the Defendant: (a) posted a letter stating that “The Defendant sold the body-to-mail first in order to sell it” at the above place on April 17, 2017; and (b) reported the above notice to the Defendant by the victim G; and (c) sold the above 150,000 won in price to the Defendant.

On the same day, 150,000 won was remitted to the Saemaul Treasury account (H) in the name of the defendant from the damaged person on the same day.

3. On June 8, 2017, around June 2017, the Defendant posted a letter stating that “The Defendant sells 7 opphones” at the above place, and the victim I reported the above notice to the Defendant, thereby selling the said mobile phone at the price of 600,000 won.

On the same day, it received 600,000 won from the damaged person to the account in the name of the defendant as stated in paragraph 2.

“The Defendant, at the home of the Defendant around June 23, 2017, sells to 5.180,000 won of gallon,” on the bulletin board of the Internet NAVand High Cafe, Nver.naver.com/joint venturena.”
