Punishment of the crime

[former Fact-finding] In the election of the 19th National Assembly members on April 11, 2012, the Defendant was registered as a preliminary candidate for D-party local constituency in Busan, and waived the candidate registration around March 21, 2012.

On March 24, 2008, the Defendant retired from the E Party on April 19, 2008, and went out to the F Party as a candidate for friendship in the area of Busan thought-gu in the 18th National Assembly election, which was implemented on April 19, 2008. On December 20, 2011, the Defendant submitted to the overseas sub-committee of the E Party overseas sub-committee on December 20, 201 in the 19th National Assembly election to obtain recommendation of E party candidate in the area of Busan thought-gu.

However, although the above documents were referred to the Busan City Party on January 16, 2012 and passed the Party Member Qualification Examination Committee on February 3, 2012, the defendant failed to obtain the Party Member Qualification Examination Committee.

As the Defendant failed to obtain the above qualification as a party member, on January 12, 2012, the Defendant registered a preliminary candidate as D to the Busan City election commission.

On February 6, 2012, from around 16:00 to 17:00, the Defendant: (a) at the events of the “Ssaong Traditional Calan Park,” opened in the Busan Sacho-dong Busan Sacho-dong Busan, the Defendant did not acquire the party member qualification; and (b) on January 12, 2012, the Defendant registered as D party candidate in Busan Seo-gu, Busan on January 12, 2012, the Defendant’s prompt color 1 “1” found 37 of the name that the Defendant appears to be the preliminary candidate for E, which was the name of the Defendant’s name.
