A defendant shall be punished by imprisonment with prison labor for not more than ten months.
Reasons
Punishment of the crime
In around 2005, the Defendant was working as an on-site partner at the B Incheon Bupyeong Branch and became aware of C working as a business employee at the time of the above company and became aware of each other.
1. On February 13, 2019, at around 11:14, 2019, a staff member in charge of deceptioning the name of fraud: (a) sent a text message stating “The victim D’s cell phone; (b) the name of the product: KRW 865,00; (c) the name of the victim’s cell phone; and (d) the statement that “E is expected to be claimed for the following month:” and (c) the victim called the Gangnam Police Station criminal charge against the victim who calls for the phone that there was no purchase of the intrusion; (d) the victim was defraudeded; (e) the bank passbook was opened in the victim’s name; and (e) the drug case was also used for the crime; and (e) the drug case was also related to the bank.”
However, the fact was that the victim did not purchase a stone-related scambling, and the above scam was misrepresented by police officers, and there was no fact that the victim was involved in fraud or narcotics in the account of the victim.
At around 15:48 of the same day, a member of the above investigation staff received money from CF Bank (Account Number: G) account in the name of CF Bank, which is a delivery book, which has been openly recruited in advance to withdraw the amount of the damage from the scamsing, and C made contact with the Defendant to deliver the above 27 million won to the above scaming operation staff. In order to communicate the above scaming operation, the Defendant accepted the above proposal and attempted to facilitate the fraud by withdrawing and delivering the said money.
On February 13, 2019, the Defendant withdrawn the above 27 million won from the I Bank (Account Number: J) account in the name of the Defendant at the Ha Bank (H) branch of the I Bank located in H around 16:00, 2019, and then is located in K at Ischeon-si, 19:00 on the same day.
