1. The Plaintiff’s obligation to pay the contract deposit under the “B” contract dated June 23, 2014 to the Defendant is KRW 548,817,325.

1. Basic facts

A. The status of the parties is a company that runs the business of manufacturing and selling internal combustion heat, automobile parts, etc., and C is a government organization under the jurisdiction of the defendant, delegated by the Minister of National Defense, pursuant to Article 2 subparagraph 1 of the Enforcement Rule of the Act on Contracts to Which the State is a Party (hereinafter “State Contract Act”), regarding contract and business management stipulated in the Defense Acquisition Program Act, such as procurement of military supplies, and C’s instructions, etc.

B. The Plaintiff entered into the instant contract 1) on June 11, 2014, the Defendant’s tender announcement (hereinafter “instant tender announcement”).

(B) On June 23, 2014, a public official in charge of contracts belonging to an agency affiliated with the Defendant (hereinafter “Defendant”) is determined as a successful tenderer of “B tender”.

B. As between the Department, 13 parts of the total of the 13 items as indicated below (hereinafter referred to as “instant parts”).

(B) “B contract” under the terms and conditions that the contract amount was totaled KRW 877,00,000, the contract bond of KRW 87,700,000,000, and the delivery date from December 10, 2014 to November 30, 2015 (hereinafter “instant contract”).

Article 2 (Definitions)

4. The term "quality assurance" means the act of inspecting the quality of munitions in order to verify whether they conform to the requirements requested by the "Contracting Officers";

5. The term "inspection" means verifying by an inspector whether the subject matter of a contract is suitable to the relevant statutes and is manufactured or installed in accordance with the relevant specifications and specifications;
