A defendant shall be punished by imprisonment for six months.

However, the execution of punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. From December 28, 2012 to May 12, 2013, the Defendant: (a) opened a waiting room, a toilet, a toilet, a kitchen, and a room in a room of about 10 stories B 5th, Jung-gu, Seoul; (b) opened a marina shop in C’s trade name by setting up four bedrooms; and (c) operated a business for domestic and foreign tourists, such as receiving a large amount of KRW 7,00,00 which is less from 19,80 per day to 10-20 customers in accordance with a marina program.

As a result, the Defendant was not a Marine but established a massage place.

2. On May 12, 2013, the Defendant, without obtaining the recognition of a massage club, performed a massage surgery against Japanese tourists and many, domestic and unspecified persons, who found the place of business for about five months, as prescribed in paragraph (1), by obtaining KRW 38,00 from D, which was caused to get marina at the shop of Jung-gu Seoul, Jung-gu, Seoul, Seoul, to receive KRW 38,00, and performing a massage surgery.

As a result, the Defendant did not obtain the recognition of Marine from the Mayor/Do governor, and carried out massage treatments for profit.

3. Around 11:20 on May 12, 2013, the Defendant: (a) at the C Maz site shop on May 12, 2013, the Defendant: (b) neglected the horses of the female who expressed his intention of refusal, and her will to see the victim D (at 30 years of age) who is a customer; and (c) was able to keep his/her hand in his/her inner clothes for a period of one hour.

As above, the Defendant forcedly committed an indecent act against the victim’s will.
