1. The defendant shall be punished by imprisonment for six months;

2.Provided, That the above sentence shall be executed for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant 2016 Highest 896 is the representative of the (ju) 609 of the D Building in Yeongdeungpo-gu Seoul, Yeongdeungpo-gu, Seoul, and the user who operates the auxiliary service.

When a worker dies or retires, the employer shall pay the wages, retirement allowances, etc. within 14 days from the date on which the cause for such payment occurred, unless the parties have agreed to extend the payment deadline.

Nevertheless, the Defendant, even from October 1, 2015 to November 1, 2015, did not pay KRW 410,960 of the wages in arrears of F, who retired from the said workplace, within 14 days from the date of retirement without an agreement between the parties on the extension of the payment deadline, and did not pay the total of KRW 80,061,605 of the wages of 198 workers within 14 days from the date of retirement, as shown in the attached Table 1 re-case of the crime committed in the attached Table 1.

On March 23, 2016, the Defendant was not detained for violating the Labor Standards Act in Seoul Southern District Court on March 23, 2016, and is currently under trial of the first instance court.

[Criminal facts] The Defendant is the representative of the (ju) E of the D Building 609 in Yeongdeungpo-gu Seoul Metropolitan Government, and is the user who runs the subsidized service business.

Nevertheless, the Defendant, who retired from the said workplace from September 22, 2014 to December 8, 2015, did not pay KRW 9,770,967 in total and KRW 3,11,90 in total and KRW 23,61,372 in total as of the date of payment between the parties without agreement on the extension of the payment deadline between the parties, and without agreement on the extension of the payment deadline between the parties.
