A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant of "2017 senior group 7875" is a representative director of the KCABD, who is in the Sungsung City Co., Ltd., and is an employer who runs the manufacturing business by using six full-time workers.
The Defendant served in the said workplace from February 1, 2014 to May 31, 2017, and retired from the said workplace; KRW 4,268,750 on April 201, 2017; KRW 3,756,250 on May 1, 2017; KRW 13,453,917 on retirement allowances; KRW 4,262,50 on April 1, 2017; KRW 3,575,00 on May 3, 2017; KRW 42,519,102 on total amount of KRW 13,205 on retirement allowances; and KRW 42,519,102 on May 1, 2017, the Defendant failed to pay the retirement allowances within 14 days from the date of retirement without agreement between the parties on extension of payment date.
The Defendant of the 2017 Highest 8440 is an employer who employs three full-time workers under the trade name of “(State) D” in the Masung City G and operates a manufacturing company.
The Defendant did not pay the total of KRW 18,246,575 of the retirement allowances of H, including KRW 4,070,932, and KRW 14,175,643, from January 2, 2014 to June 30, 2017, when he/she retired from the said workplace without any agreement on extension of the payment date, within 14 days, when he/she retired from the said workplace without any agreement on extension of the payment date.
The defendant of "2018 Highest 2251" is an employer who employs four full-time workers as a (ju) D representative director in Masung City, and engages in manufacturing business related to lighting.
1. The Defendant did not pay KRW 4,312,50 of the J’s wage in April 23, 2014 to May 31, 2017 at the above workplace, and did not pay KRW 20,103,125 of the total wages of two workers within 14 days from the date of retirement, as shown in the list of crimes in the attached Table, as shown in the attached Table.
2. The Defendant did not pay KRW 12,963,315 of the above J’s retirement pay within 14 days from the date of retirement without any agreement between the parties on the extension of the payment deadline.
