A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Except for the Seoul Olympic Sports Promotion Foundation and entrusted business entities, no person, other than sports promotion betting tickets or similar things, shall provide property or property benefits to persons who correctly predicted the result, and no person, other than the Seoul Olympic Sports Promotion Foundation and entrusted business entities, shall open a space for gambling for profit.

피고인은 E, F, G, H, I, J, K, L, M, N, O과 함께 국민체육진흥법에 따른 투표권을 발매하는 ‘스포츠토토’와 비슷한 인터넷 도박 사이트를 운영하기로 공모하고, 일본에 사이트 운영 서버를 두고 국내에는 화성시 P, A동 2303호 및 같은 지번 Q 오피스텔 404호 등에 방송홍보 등 회원 유치를 담당하는 운영 사무실을, 해외에는 태국 방콕 수쿰빗 39에 있는 불상의 콘도 17층 2호 등에 사이트, 회원관리 및 송금 업무를 담당하는 운영 사무실을 각각 두고, “R”라는 인터넷 도박 사이트를 개설하여 운영함에 있어, E은 국내사무실을 개설하고 범행을 총괄 지휘하고, J, K는 중국, 태국 등지에 사무실을 개설하여 해외 사무실을 관리하고, L, M, I는 태국 현지의 콜센터에서 경기 일정 및 결과를 위 인터넷 도박 사이트에 올리고 회원들의 요청에 응하여 사이버머니 충전 및 환전 등의 업무를 하고, 피고인, G, F, H, N, O은 국내에서 인터넷 방송인 S 등을 통해 위 사이트를 홍보하여 회원들을 모집하는 역할을 각 수행하기로 하였다.

In collusion with E, J, K, L, M, I, G, H, H, H, N, andO, the Defendant recruited members to gamble by advertising the domain name address, recommended ID and code numbers necessary for the real-time opening of the site, and broadcasting the schedule and results of various sports games, such as camping districts, axiss, and farming spaces, from October 2013 to May 24, 2014.
