Reasons
Punishment of the crime
The defendant is a disguised marriage hub between Vietnamese women and Korean men, and B is a person who recruits domestic men who respond to such disguised marriage and introduces them to the defendant.
1. Around November 2010, the Defendant introduced C with the intent to offer money for a disguised marriage with Vietnam women by making a disguised marriage with the new-dong, Yangcheon-gu, Seoul. Around November 201, the Defendant sent documents necessary for a disguised marriage to “D”, a disguised marriage broker in Vietnam, and left Vietnam by sending documents necessary for a disguised marriage, and received documents for a disguised marriage from “D” to obtain a certificate of marriage. Around November 201, the Defendant took charge of domestic procedures necessary for a disguised marriage, such as accepting documents necessary for a disguised marriage from “D,” and granted KRW 6 million from “D,” and paid KRW 3 million to “D,” and the Defendant paid KRW 2.5 million to “B,” under the pretext of expenses.
C around 10:00 on December 24, 2010, around 10:0, within the Yangcheon-gu Office of Yangcheon-gu Seoul, Yangcheon-gu, Seoul, 6.321-4, to enter the Republic of Korea, submit a marriage report between C and F to the public official in charge of family relationship affairs of the above Gu office, and have the public official in charge record C and F enter and store the fact that C and F were married in the family register information system, which is a public electronic record, and the defendant and B were accompanied when they reported their marriage as above.
Accordingly, in collusion with B, C, F, and D, the Defendant made a false report to a public official, thereby making a false statement in the family register information system, which is a public electronic record.
2. The Defendant and B met the following events: (a) around that time, the Defendant and B met the public electronic records containing false facts; and (b) exercised them by having them keep them.
