A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant operated the “D” in the South-west Sea C, and from around 2006, from around 2006 to around 30 members, the Defendant entered the funds to be given to the fraternitys or members who did not receive the fraternitys by collecting the fraternitys on the designated date, and then awarded the fraternity to the fraternity members, which recorded the lowest amount (the highest amount) in the form of interest, and paid the fraternitys, and operated the so-called “successful bid” in which the interest from the successful bidder was divided in proportion to the payment of the fraternitys to be paid in the future by the persons who excluded the fraternitys, or divided the fraternitys in the form of interest.

Around November 23, 2010, the Defendant made a false statement to the victim E, stating, “If a monthly payment is made by joining the lowest bid price of 1 million won per month, the Defendant would normally pay the relevant fraternity when the order of successful tender is later.”

However, on February 2010, the Defendant: (a) had the intention to operate a system in the so-called “fluoring” method, in which the previous guidance was not operated due to the failure of the members of the previous guidance to pay the guidance money due to the failure to pay the guidance money properly; and (b) had the Defendant subscribed the said victim by organizing the successful bid system on November 23, 2010; and (c) as a member of the above successful bid system, many of the members except the victims, etc., who had already been responsible for a large amount of debt to the Defendant, or who had not been in the operation of other guidances due to the payment of the funds received from the victims, etc., the successful bid amount of such members was awarded to the Defendant.
