The Defendant B and his defense counsel asserted that the Defendant’s act constituted self-defense against A, etc., even though the Defendant’s act constituted self-defense, in light of the form and degree of the Defendant’s act recognized in the above crime, it appears that the Defendant’s exercise of force beyond the self-defense of the resistance means to escape from an unlawful attack, and thus, the above assertion is difficult to accept.
