The prosecutor's appeal is dismissed.

1. According to the evidence submitted by the prosecutor including the statement of D in the summary of the grounds for appeal, although it can be recognized that the defendant committed each of the crimes listed in the facts charged in the instant case, the court below acquitted the defendant, and there is an error of mistake of facts.

2. The court below, based on the evidence duly adopted and examined by the court below as to the facts charged in this case against the defendant, found the defendant not guilty on the grounds that the defendant's credibility of D's statement was rejected for reasons as stated in its reasoning and the facts charged in this case constitutes a case where there is no proof of crime. If the records in this case and the reasoning of the court below's ruling are closely compared, the court below's above judgment is acceptable, and even if the prosecutor's appeal is examined, it is judged that there was no error

3. Therefore, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the grounds that the appeal is without merit. It is so decided as per Disposition.
