Reasons

1. Circumstances of the disposition;

A. On November 11, 2002, the Plaintiffs acquired the right to acquire 416 square meters from the Kimhae-si ○○○○○○○○, 250-4 quasi-residential land (hereinafter “instant right to sell”) from 1/2, and transferred the right to Bront on June 23, 2003.

2. Whether the disposition is lawful;

A. The plaintiffs' assertion

The transfer value based on the actual transaction value of the instant sales right is KRW 150,000 (the Plaintiff’s share transfer value is KRW 75,000,000). Therefore, the portion exceeding the legitimate tax amount calculated on the premise of the said amount among each of the dispositions of this case is unlawful.

B. Determination

(1) In full view of the statements in Gap evidence 1-1-2, Gap evidence 2, Eul evidence Nos. 4 through 8, and the purport of the entire pleadings in the testimony of △△△ witness, the plaintiffs concluded a sales contract with 283,50,000 won, adding the amount of KRW 73,520,000,000, which was paid between B/L and B/L on June 9, 2003, and the amount of KRW 283,50,50,000,000, which was paid between B/L with B/L on June 9, 2003, the plaintiffs received KRW 57,00,000 per contract and remitted the down payment of KRW 41,38,520,000 per cash.

(2) According to the above facts, the actual transfer value of the sale right of this case is KRW 283,50,000. Accordingly, each of the dispositions of this case against the plaintiffs of the defendants that reported as such is lawful.
