A defendant shall be punished by imprisonment for not less than one year and six months.

Criminal facts

On July 2015, the Defendant introduced the victim D, who worked as B University C Campus teachers, as if he was a business engaged in clothing export business in Seoul Dongdaemun-gu, Seoul, and began to engage in an internal relationship with the said victim. On the other hand, the Defendant attempted to acquire money from the victim under the pretext of real estate investment and acquisition of a business entity.

1. Regarding the first floor F of the E-building in Jung-gu, Seoul;

A. On September 2015, the Defendant made a false statement that “The Defendant made a false investment with the victim, “The first floor F of the 1st floor under the Seoul Jung-gu E building, Seoul, to be able to rent KRW 1,000,000 per month after leasing the 1st floor F commercial building under the name of the party,” around the Seocho University C Campus.

However, in fact, the defendant was thought to be used for the purpose of the repayment of personal debt by the victim, and there was no intention or ability to rent real estate or pay monthly rent for the victim.

Around September 11, 2015, the Defendant, by deceiving the victim, received KRW 32,00,000 from the victim’s account in the name of the Defendant (H).

B. The Defendant forged a private document

1. On September 8, 2015, in order to use it for the same crime as described in paragraph (a), “2,710 square meters”, “1,620.83 square meters”, “3.77 square meters”, “3.7 square meters in the column of the building area”, “1,620.83 square meters in the column of the building area”, “3.77 square meters in the column of the deposit amount”, “3.7 square meters in the column of the deposit amount”, “10 million won in daily payment,” and “20 million won in the column of the down payment”, and in the column of the lessor “ Address, N apartmentO, resident registration number, number, P, telephone, name M”, and “M” in the column of the lessee.
