피고인은 2016. 2. 29. 00:00 경 경기 성남시 중원구 B, 2 층에 있는 피고인의 주거지 내에서, 아이들 양육문제로 말다툼을 하다 화가 나자 배우 자인 피해자 C( 여, 35세 )에게 " 씨발 년 아, 아들을 놓고 몽골로 가라 "라고 말하며 손으로 피해자의 머리채를 잡고 오른 손바닥으로 피해자의 왼뺨을 5회 때리고 오른손 주먹으로 피해자의 입을 1회 때리고, 피해자의 갈비뼈 부위를 3회 때린 후 피해자를 바닥에 넘어뜨린 다음 오른발 발바닥으로 피해자의 배를 수회 밟아 피해자에게 치료 일수 불상의 치관- 치근 파 절의 상해를 가하였다.
