A defendant shall be punished by imprisonment for five years.
Reasons
(b) Crime history;
1. On June 5, 2008, the Defendant was sentenced to imprisonment with prison labor for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes at the Suwon District Court on the Aggravated Punishment, etc. of Specific Crimes, for two years and six months, and was sentenced to three years from May 20, 201 to three years from his/her imprisonment with labor for the same crime in Ansan District Court, and completed the execution on January 21, 201.
2. Criminal facts;
A. At around 23:00 on November 27, 2014, the Defendant habitually stolen d apartment in Ansan-gu, Ansan-gu, the house of the victim C ***** Dong****, by putting his fingers together with the shouldered window, and putting the locking device into a house with a percentage of the locking window, and bring about one half of the dust half of the C’s ownership (al. 500,000 won), one gold dog (al. 200,000 won), and 2 punishment (al. 70,000 won) with a wind door (al. 7,00 won).
In addition, the Defendant stolen the victims' property or invaded their residence at night at all eight times as shown in the attached Table 1 between July 30, 2015 and July 30, 2015.
B. On May 3, 2015, around 01:59, the Defendant offered F’s F’s National Card (G) that was stolen as shown in attached Table 1’s Schedule 5 in the name of payment of tobacco to employees at the convenience point of the victim’s operation, where the name located in Ansan-si E cannot be known, as of May 3, 2015, to the employees, and signed the sales slip as if they were a legitimate holder. The Defendant was issued a 45,000 scarb tobacco amounting to KRW 45,00.
In addition, during the period from May 22, 2015 to May 22, 2015, the Defendant used all lost or stolen credit cards on six occasions as shown in the attached Table 2, and thereby received property worth KRW 225,000 by deceiving others.
C. The Defendant embezzled the stolen property that has been occupied by another person on two occasions as follows.
(1) The Defendant is between 01:00 and 02:00 on May 22, 2015.
