The defendant shall be innocent.

The summary of the facts charged was a public official belonging to the government integrated computer center, who was dismissed on October 21, 2015, and on September 10, 2015, the judgment was finalized on November 10, 2016 after being sentenced to the suspension of execution of one year, fine of ten million won, and additional collection of five million won for a bribe by the Gwangju District Court.

If a public official retires, is removed, or is removed from office due to an act of corruption in connection with his/her duties while in office, he/she shall not be employed for at least five years from the date of his/her retirement in a for-profit private enterprise closely related to the duties of the department to which he/she belonged for three

Nevertheless, on April 18, 2016, the Defendant was employed in B, which was publicly notified as a for-profit private enterprise subject to employment restrictions for retired public officials in 2016.

In light of the following circumstances acknowledged through each evidence duly adopted and investigated in this Court, the evidence submitted by the prosecutor alone was proved to the extent that the Defendant constitutes a private enterprise closely related to the business of “general administration” as stated in the facts charged that the Defendant was employed before his retirement (hereinafter “instant enterprise”).

It is difficult to see, and there is no other evidence to prove it.

In light of the following: (a) although it is recognized that the instant company purchased a mergy storage device (hereinafter “instant device”) manufactured by the instant company at the national market at around 2014, the department that received the goods by selecting the actual goods at the request for cooperation with the security communication is in line with security communication (Evidence 59, 124-153 page); and (b) one general management department examines the instant product and prepares a tally report and an inspection report (Evidence 147, 148 page); (c) however, in light of the nature, use, quantity, etc. of the goods.
