A defendant shall be punished by imprisonment for not more than ten months.

Seized evidence subparagraph 1 shall be forfeited from the accused.

Punishment of the crime

On December 13, 2013, the Defendant was sentenced to two years of imprisonment with prison labor for general goods and fire prevention at the Seoul Central District Court, and on December 21, 2013, the said judgment becomes final and conclusive and is still under probation.

피고인은 2014. 3. 1. 토요일 18:40경 위 서울역 광장에서, 평소 안면이 있는 노숙자인 피해자 C(남, 54세)이 일행들과 술을 마시는 것을 발견하고 그 일행 중 1명에게 반말을 하면서 시비를 걸었고 이에 피해자가 “넌 누군데 내가 제일 좋아하는 형님에게 반말을 하냐”며 따지자, 피고인의 바지 주머니에 흉기인 커터칼(총길이 13cm, 칼날길이 8cm)을 소지하고 있는 상태에서 왼손으로 피해자 멱살을 잡아끌고 오른손으로 바지 주머니에서 커터칼을 꺼내 피해자의 목에 들이대고 “너 이 새끼 죽여버린다”고 말하였고, 이를 피하던 피해자가 뒤로 넘어졌다가 일어나자 다시 왼손으로 피해자의 멱살을 잡아끌고 오른손에 들고 있던 커터칼을 피해자의 목에 들이댔다.
