Defendant shall be punished by a fine of KRW 3,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

The Defendant is the head of production of livestock product processing business and food manufacturing business, called "C", in Monosan-gun B.

1. In cases of tracking and managing the names, manufacturing methods, ingredients, dietitians, raw materials, uses and quality of livestock products, the packaging of livestock products and the records of the processing of livestock products, no person who violates the Sanitary Control of Livestock Products shall make any indication or advertise differently from the facts in indicating the date of manufacture, distribution period, eggs, days of production or distribution, and other dates;

On January 13, 2015, the Defendant: (a) replaced an inventory product of approximately KRW 9,900 on the date of manufacture with a new package, and around KRW 157,080 on the market price; and (b) indicated the date of manufacture differently from the fact as “ October 13, 2015; and (c) manufactured and distributed a deductible product of KRW 3,023,355 on three occasions from around January 13, 2015 to May 15, 2017, livestock products of KRW 42,39,967 at the market price.

2. No person who violates the Food Sanitation Act shall place any false indication or advertisement with regard to the indication of the date of production or the period of distribution in relation to the name, manufacturing method, quality, nutrition labelling, genetic re-cooperative food, etc. and the tracking and control of food history of foods, etc.;

Nevertheless, on October 24, 2017, the Defendant manufactured and distributed the inventory products of approximately KRW 48,000, the market price of which was manufactured on or around December 17, 2017, with a different indication from the fact, that the date of manufacture was “0,000,” which was manufactured on or around December 24, 2017.
