Reasons
Punishment of the crime
The defendant is a person who actually operates D Co., Ltd., a group meal facility sales business company in Hanam-si, and E is a person who operates G, a group meal facility sales business company in Hanam-si F.
E participated in the bidding as if it were to directly supply and process the e-mail products of the "School Meal Electronic Procurement System (EAT)" food products (EAT) in the Korea Agricultural and Fishery Products Distribution Corporation operated by the Korea Agricultural and Fishery Products Distribution Corporation.
However, in fact, in G Co., Ltd., there is no livestock or processing facility that can be supplied to the school from the beginning, so if the successful bid is awarded, a successful bid will be awarded in return for fees to D Co., Ltd., and the Defendant, upon receiving a successful bid from G Co., Ltd., planned to directly process school meal products and supply them in the name of G
1. Accordingly, from G to December 31, 2015, E participated in an electronic bid of the “EAT” food goods of the School Meal Electronic Procurement System (EAT)” through 20 times, including H high schools, and won a successful bid, and the Defendant offered it to D Co., Ltd. operated by the Defendant, thereby providing collective meal services to G in a group of companies.
2. From January 2016 to December 31, 2016, the Defendant participated in an electronic bid for the “School Meal Service Electronic Procurement System (EAT)” (EAT) and received 45 times a successful bid for the group meal service in D Co., Ltd. as if he/she participated in the 45-time electronic bid for the school meal goods (scams).
As above, the Defendant and E, in collusion, shall receive the fees only for winning the contract in the name of G Co., Ltd. for the electronic bid for the meal goods (EAT) of the “School Meal Electronic Procurement System (EAT), and have a substitute supply, or participate in the bidding as if they were competing with each other under the company code, such as the list of crimes, from April 2, 2015 to April 2, 2016.
