The punishment against A shall be 5,00,000 won, and the punishment against Defendant B shall be 4,000,000 won, respectively.
Reasons
Punishment of the crime
1. The Defendants jointly run the real estate real estate agent office in the name of E in Jung-gu Seoul, Jung-gu, Seoul, from May 201 to February 28, 2012, with the name of F real estate agent from May 201 to February 27, 2012.
Defendant
A performs the duties of brokerage assistant, such as collecting information necessary for the brokerage of lease, and inducing customers, such as identifying the stores of G commercial stores, neighboring real estate, and the current status of merchants wishing to sell commercial buildings. Defendant B, as a broker, provided consultation with customers visiting offices based on the information identified by Defendant A and provided a brokerage contract in accordance with the required conditions. When a contract is concluded, it performs the duties of arranging a lease contract according to the required conditions.
In mediating a commercial lease contract, the broker, etc. shall receive the brokerage commission for the object of brokerage from both the clients, and the limit to which one party can receive may be determined within the limit of 9/100 of the transaction amount.
The Defendants, in collusion with H on June 13, 201, brokered L to rent KRW 40 million,000,000 and KRW 2,300,000 per month for the first floor E-21 of the G shopping district located in Jongno-gu Seoul Metropolitan Government, Jung-gu, Seoul to rent KRW 40,000,000 and KRW 9,000,000 from L in excess of the statutory brokerage commission.
B. On July 6, 2011, the Defendants conspired to arrange for N to rent KRW 20 million per month, and KRW 1900,000 per month, and received KRW 5,00,000 from lessee N in excess of the statutory brokerage commission from the lessee N.
C. On November 28, 2011, the Defendants conspired to arrange for a P to rent a store owned by G shopping mall E fever 4 at the above F real estate office for KRW 20 million and KRW 2.6 million per month, and the lessee’s legal brokerage commission exceeds KRW 2.52 million.
