1. The defendant shall be the plaintiff.
A. Of 60 square meters of a parking lot in Gangseo-si, the attached drawing 12, 13, 24, 23, and 12 shall take precedence over others.
Reasons
1. Basic facts
A. The Plaintiff owns 60 square meters of a parking lot C in Gangseo-si (hereinafter “the instant land”) and D 31 square meters (hereinafter “the instant land”) and D 331 square meters (hereinafter “the instant land”). The Plaintiff owned each of the instant land, including the instant land Nos. 1 and 2, and the Defendant owns a building indicated in the attached Form No. 1, which is located in Gangseo-si E located in the neighboring area of each of the instant land (hereinafter “instant building”).
나. 이 사건 건물 가운데 일부는 이 사건 제1토지 가운데 별지 도면 12, 13, 24, 23, 12를 차례로 이은 선 안의 (ㅅ) 부분 1㎡(이하 ‘㉦ 부분’이라 한다), 이 사건 제2토지 가운데 별지 도면 11, 12, 23, 11을 차례로 이은 선 안의 (ㄹ) 부분 1㎡(이하 ‘㉣ 부분’이라 한다) 위에 세워져 있고, 이 사건 건물에 부속된 시멘트구조물은 이 사건 제2토지 가운데 별지 도면 9, 10, 22, 9를 차례로 이은 선 안의 (ㄷ) 부분 1㎡(이하 ‘㉢ 부분’이라 한다) 위에 세워져 있다.

2. Assertion and determination
가. 원고의 청구에 관한 판단 위 인정 사실을 종합하면, 피고는 원고에게 ㉢, ㉣, ㉦ 부분 위에 세워진 건물과 시멘트구조물을 철거하고, ㉢, ㉣, ㉦ 부분을 인도할 의무가 있다.
B. The Defendant alleged that part of the building of this case did not comply with the Plaintiff’s claim because the boundary surveying conducted by the Korea Land Information Corporation was erroneous. However, the ground alleged by the Defendant is only an internal relationship between the Defendant and the Korea Land Information Corporation, and it does not constitute a ground to oppose the Plaintiff, since it is only an internal relationship between the Defendant and the Korea Land Information Corporation.
We do not accept the defendant's argument.
