1. The Defendant (Counterclaim Plaintiff) is not less than 5,097 square meters of forest land in Gangseo-si, Gangnam-si, with the Plaintiff (Counterclaim Defendant)

1. Basic facts

A. D owned a forest land 5,752 square meters in Gangseo-si, Gangnam-si, Seoul Special Metropolitan City (an E forest land 655 square meters was divided on May 24, 2013, and 5,097 square meters was divided; hereinafter “instant land 1”) and a F-516 square meters in adjoining the instant land (hereinafter “instant land 2”) and a house owned on the said land.

B. D The Plaintiff died on August 23, 1971. The Plaintiff completed the registration of ownership transfer on the land of this case on August 13, 1981 under the former Act on Special Measures for the Registration, etc. of Real Estate Ownership (Act No. 3159, invalidation, and invalidation; hereinafter “Special Measures Act”) with respect to the land of this case on August 13, 1981, pursuant to the former Act on Special Measures for the Registration, etc. of Real Estate Ownership (Act No. 7500, Jan. 12, 2007). The Defendant completed the registration of ownership transfer on the land of this case on January 2, 2007 by inheritance on August 29, 1971.

C. Of the instant land No. 1, the attached Form 15, 16, 17, 18, 19, 42, 43, 44, 45, 46, 47, 48, 49, 50, 25, 26, 27, 39, 40, 41, and 15 shall be used as a road having access to the Defendant’s housing located on the instant land 2, with a concrete package in the order of 138 square meters (hereinafter “cock”), and the portion within 138 square meters of the attached Form 1 is used as a road having access to the Defendant’s housing located on the instant land 3,52, 53, 54, and 51 square meters in order of 51, 54, 43, 47, 244, 37, 294, 47, 47, 47, 420.”

On September 1, 2015, the Defendant sent against the Plaintiff the Chuncheon District Court order 2015dan5848.
