A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
On March 25, 2020, the Defendant accepted the proposal and sent it again to the account designated by the Defendant’s name in the name of singishing operator who misrepresented C with B, and then notified the said singishing operator of the number of the DB account (Account Number: E) in the name of the Defendant.
Around April 1, 2020, the said Bosing staff assumes a false position as F staff and calls from the victim G to the victim G at an interest rate of 3.2%. The said Bosing staff makes a false statement to the effect that “45,000,000 won may be loaned at an interest rate of 3.2%. As a low interest rate loan is impossible if there is any existing loan, and thus repayment of KRW 5,901,000 is possible, the said employee made the victim remit the said D Association account under the name of the Defendant on the same day.”
On the same day, the Defendant released KRW 5,900,000, out of the said money at the I.S. O. O.S. O. O.S. O. O.S. O.S. O.S. A.F., under the direction of the said I. H., and thereafter, the Defendant suspended payment on the ground that the said D.C. account in the name of the Defendant was used for the crime of Bophishing fraud, and thus, the money transferred from the Defendant’s name to the Defendant was inflicted on the Defendant from the victim, under the direction of the said I.S. staff, he received the said KRW 5,900,000 from the K.S. T. H. H. H. H., the Defendant knew that the money was caused by the crime of Bophishing fraud.
As a result, the Defendant aided and aided the criminal act of fraud by a staff member of scaming in name.
