Punishment of the crime

1. Defendant A is the representative of “B corporation” and “B corporation”, which is a mail order business entity located in Gyeong-gun, Gyeong-gun, Chungcheongnam-gun, Chungcheongnam-gun, Gyeong-gun, and sells kimchi through the Internet, etc.

No one shall sell foods, etc., the standards for labeling of which are determined, import, display, transport such foods for sale, or use them for business unless such standards are indicated.

The Defendant concluded a kimchi supply contract with the representative H of “G”, which is a mail order company located in the Nam-gu, Daegu-gu, and made kimchi ordered by H in the Internet at the above “B corporation,” and decided to sell the kimchi via a house at the consumers’ domicile at the order of H.

On April 9, 2012, the Defendant sold to I totaling KRW 205 (total KRW 1,865kg), total amount of KRW 9,359,000, including e-granchi, e-granchi, small-scale storage, and white-kim, in the state where “the name and location of the manufacturer, date of manufacture or distribution, ingredient name, and content”, which are indicated in the labelling standard publicly notified by the Commissioner of the Korea Food and Drug Administration, are not indicated. From April 9, 2012 to May 18, 2012, the Defendant sold to I totaling KRW 205 (total KRW 1,865kg), total amount of KRW 9,359,00,00.

B. No one shall use the contents of the name, manufacturing method, nutritional values, raw materials, ingredients, and usage of food, etc., or the contents of the “certification”, “guarantee”, or “Recommendation”, or advertise similar contents, and there is no fact that the Defendant has obtained the certification of good agricultural products from the Gyeong-gun Office of the Gyeongcheon-gun Office with respect to kimchi that he/she manufactured and sold.

Nevertheless, on November 17, 2011, the Defendant falsely advertised that he/she has obtained the certification of excellent agricultural products in franchi in the Internet shopping mall (J,K, and L) by using kimchi produced by the Defendant as “certification of excellent agricultural products in franchi,” and M. Kimchi.
