A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who manufactures “C” in Mapo-gu Seoul Metropolitan Government, i.e., the food taken in, and sells it to an individual convenience store, etc.

No one shall place any false, exaggerated, or exaggerated labeling or advertising that is different from facts or exaggerated labeling or advertising with respect to the names, manufacturing methods, quality or nutrition labellings of foods, etc., and genetically modified foods, etc. and food traceability labeling or advertising.

그럼에도 불구하고, 피고인은 2015. 3. 1.경부터 2015. 6. 24.까지 위 ‘C’에서, 관할 행정기관인 마포구청에 해당 제품 품목제조보고시 유통기한을 제조일로부터 냉장 보관시 48~158시간으로 품목보고하고, 즉석섭취식품인 ‘피자맛핫도그, 매운빅불벅, 후레쉬샌드위치, 호밀에그샌드위치’ 등 37개 품목을 제조ㆍ판매하면서, 제품에 대한 “제조년월일”은 포장을 제외한 더 이상의 제조나 가공이 필요하지 아니한 시점에 ‘제조년월일’을 표시하여야 함에도, 해당 제품은 당일 오전 9시 30분경에 제조하여 더 이상 제조ㆍ가공이 필요하지 않은 완제품 상태로 보관하고 있다가, 당일 해당 제품 출고 시 그 시점을 기준으로 제품의 표시사항 스티커 라벨지에 제조일시를 15시로 표시하여, 원래 제품의 제조일시보다 5시간을 변조(연장)하여, 별지 ‘범죄일람표’ 기재와 같이 수도권에 소재한 개인편의점에 위 기간동안 제조일시를 변조한 즉석섭취식품인 ‘뉴-에그샌드’ 381개, 시가 금 290,550원, ‘에그샐러드 샌드위치’ 331개, 시가 금 414,711원, ‘뉴-햄치즈샌드’ 1,597개, 시가 금 1,261,500원, ‘햄샐러드 샌드위치’ 722개, 시가 금 889,064원 등 도합 37개 품목 50개 종류 제품에 대하여 총 190,278개 시가 총액 173,028,820원 상당을 판매하였다.
