Reasons
1. Facts of recognition;
A. The status of the parties (1) (A) A Co., Ltd. (hereinafter “B”) and C Co., Ltd. are located on June 25, 2012 (hereinafter “C”) means a place where a water source system and equipment, such as a special pressure or high voltage changer, power distribution team, measuring device, closing device, etc., are installed.
In accordance with the size of voltages classified by the standards for electric installations, the voltage exceeding 7,005 is classified as special pressure. A contract for the safety management of electric installations (hereinafter referred to as the “electric installations of this case”) was concluded on behalf of an agent for the safety management of electric installations (hereinafter referred to as the “instant agency contract”).
(B) The Plaintiff is one of the representatives of C, who is qualified as an electrical industrial engineer, and was appointed as an electrical safety supervisor B under the instant agency contract, and thereafter became responsible for the safety management of electric installations B.
(2) (A) In order to prevent disasters caused by electricity pursuant to Article 74 of the Electric Utility Act, the Defendant is a corporation established to conduct research, technology development, and publicity work concerning electrical safety and to conduct inspections and checkups of electric installations.
(B) E performed the duty of inspection while serving as the chief of the inspection division belonging to Defendant F regional headquarters, and G as the staff of the said inspection division, respectively, while performing the duty of inspection of electric installations.
