A defendant shall be punished by imprisonment for not less than eight months.
Reasons
Punishment of the crime
1. Around July 29, 2013, the Defendant forged private document: (a) entered and printed out the phrases, such as “A”, “A”, “A”, “A”, “A”, and “A”, which were stored on the computer at the same location, shall enter into a sales contract for unused materials (equipment) as follows; (b) 10 years from the date of the contract under Article 1 (Contract Period); and (c) “A”, “A” shall be automatically extended unless there is serious economic damage to A” due to a serious cause attributable to B; (d) the “E representative director F”, “A”, and “A” (Gu. G.) signed and printed out a contract for the sale of unused materials (equipment) in the name of the representative director of E Co., Ltd. in the name of E Co., Ltd.; and (e) signed and sealed the official seal of E Co., Ltd. prepared to be the president of EF later.
Accordingly, the defendant, in collusion with D, forged one copy of the contract for sale of disused materials (equipment) in the name of the president of E representative director, who is a private document related to rights and obligations, for the purpose of exercising.
2. On October 20, 2013, the Defendant presented a copy of the above investigation document to H as if it were a document duly formed with the completion of the contract on the sale of disused materials (equipment) as stated in the above paragraph (1) at the coffee shop located in Yeongdeungpo-gu Seoul Metropolitan Government, Yeongdeungpo-gu, Seoul.
Accordingly, the defendant exercised a forged document.
3. The Defendant entered into a contract with the victim for the supply of unused materials (equipment) for a period of ten years from F, the representative director of the E-stock company, although the Defendant did not have the intent or ability to allow the victim to carry on the scrap metal business even though the Defendant received money from the victim H as business promotion expenses.
