Punishment of the crime
[2011 Highest 2720] The Defendant is a person who works as the president of the Association of North Korea-Sin-gun.
1. The Defendant committed the crime against the victim E, despite the absence of the intent or capacity to supply the victim E with environment-friendly agricultural equipment and materials such as piracy collection devices to domestic farmers or export them to foreign countries, the Defendant concluded a contract with the victim for the supply of environment-friendly agricultural equipment and materials such as piracy collection devices, etc., and received money in return for the project promotion cost or the support fund of the said association from the Defendant’s husband and wife for use for the business fund of “G” and other personal use expenses.

However, the fact is not entirely selected as the target for the environment-friendly agriculture fund, and the farmer is selected as the target for the support, which has many restrictions, so there was no intention or ability to cause the victim to supply the environment-friendly agriculture equipment and materials, such as piracy.
