A defendant shall be punished by imprisonment for a term of one year and two months.

Punishment of the crime

1. The Defendant is a person engaging in driving a motor bicycle BSV125B motor vehicle in violation of the Act on the Aggravated Punishment, etc. of Specific Crimes and the Road Traffic Act (unclaimed Measures after Accidents).

At around 14:10 on November 25, 2018, the Defendant continued to drive a four-lane of the road in front of Seongbuk-gu Seoul Metropolitan Government, Seongbuk-gu, at approximately 50km from the right side of the end rock to D, at a speed of about 50km each hour.

In this case, there was a duty of care to observe the vehicle signal to those engaged in driving of a motorcycle, and to prevent accidents in advance by accurately operating the steering direction and brake system while thoroughly operating the steering time.

Nevertheless, the Defendant neglected this and neglected to enter the intersection while the vehicle signal is red signal and proceeded as it is, by negligence, got the front side of the victim E(44 years old) driving at the normal left-hand turn according to green signal, and received the front side of the Defendant’s motorcycle.

As a result, the Defendant, by the above occupational negligence, suffered salt and tensions from the chills that require approximately two weeks of treatment, and at the same time, escaped without immediately stopping the strawers, etc. to cause damage to the 1,130,050 won of the repair cost, and without taking measures such as providing relief to the victims.

2. No person who violates the Compensation of Automobile Accident Compensation Act shall operate any motor vehicle on a road which is not covered by mandatory insurance;

Nevertheless, the Defendant operated the above motorcycle (wheeled Automobile) at approximately 2 km section from the unclaimed land in Gangnam-gu Seoul Metropolitan Government, Gangnam-gu to the front road in Seongbuk-gu, Seoul, without mandatory insurance.
