1. Details of the disposition;

On May 4, 2018, the Defendant requested on May 8, 2018, the Plaintiff to attend a deliberation committee on dismissal of military forces from the small assembly room of 14:00 on May 8, 2018 pursuant to Article 17 of the Military Personnel Management Act and Article 58 of the Regulations on the Personnel Management of Officers 110 on the Army.

On May 8, 2018, the Defendant held a deliberation committee on the dismissal of a military team from office against the Plaintiff. As a result of the deliberation, the Defendant issued a disposition to dismiss the Plaintiff from office as stipulated in Article 58 of the Military Personnel Management Regulations (hereinafter “instant disposition”) on the ground that the Plaintiff’s breach of dignity (Intimidation, insult) falls under the grounds for disciplinary action and the criteria for determination as stipulated in attached Table 2 of the Disciplinary Rules 180 of the Army Regulations.

C. On June 4, 2018, the Plaintiff appealed against the instant disposition and filed an appeal with the National Military Personnel Review Committee of the Ministry of National Defense, but the appeal review was dismissed on May 17, 2019.

On the other hand, on May 23, 2018, the Defendant: (a) based on Article 56 of the Military Personnel Management Act, committed the following disciplinary charges against the Plaintiff; (b) on the grounds that the Defendant committed a violation of the duty to maintain dignity and the duty to maintain dignity under the name of a disciplinary case; and (c) on the other hand

1. The victims of the breach of their duty to maintain their dignity (Intimidation), subrogated E, Captain F, and First Lieutenant G are those who perform the duties of the First Lieutenant.
