피고인은 2018. 1. 7. 00:15 경 부천시 C에 있는 'D 식당' 내에서 옆 테이블에 앉아 있던 피해자 E의 일행이 시끄럽게 떠들어 조용히 해 달라고 말하였으나, 피해자가 " 짱 개, 씨 발" 이라고 욕을 한다고 생각하여 화가 나 손으로 피해자의 머리 부위를 1회 밀어 폭행하였다.
