1. 업무방해 피고인은 2013. 6. 27. 05:20경 부산 북구 B에 있는 C 편의점에서, 술에 취한 채 이유 없이 판매용 아이스크림과 껌을 던질 때 피해자 D(44세)이 "왜 그러느냐"고 항의하면서 경찰에 신고하겠다고 한다는 이유로 피해자에게 "야 개새끼야, 뭘 쳐다보냐, 씹할 놈아"라고 하면서 주먹으로 때릴 듯이 폼을 잡고, "야 씹할 놈아~ 조선족 새끼야, 내 친구가 검사, 경찰이 있다, 한번 불러봐라"며 고함을 치는 등 약 20분 동안 행패를 부렸다.

Accordingly, the defendant interfered with the victim's convenience store operation business by force.

2. 모욕 피고인은 위 일시 장소에서 위와 같이 행패를 부리던 중 피해자인 북부경찰서 경위 E(51세)이 신고를 받고 출동하자 기분 나쁘다는 이유로 종업원 D 등 6-7명이 보는 앞에서 피해자에게 "야 씹할 놈들아~ 니가 경찰이가 내 친구가 검사인데 다 죽었다, 씹할 놈들아" 등의 욕설을 하고, 현행범으로 체포되어 연행된 북부경찰서 F지구대에서 기분이 나쁘다는 이유로 위 D 등 6-7명이 보는 앞에서 피해자에게‘안경잽이 새끼가 지랄하네씹할 놈아 개새끼야 병신새끼야 너의 딸 아들 교육 잘 시키라 씹할 놈아’라고 하는 욕설을 하였다.

Accordingly, the defendant openly insultingd the victim.
