The defendant's holding is a fine of 3,00,000 won for each possession of stolen property embezzlement, computer, etc., and fraud by use of computer, etc.

Punishment of the crime

On June 19, 2014, the Defendant was sentenced to a suspended sentence of four months by imprisonment with prison labor for embezzlement of stolen objects, etc. by the Seoul Central District Court on June 19, 2014, and the said judgment became final and conclusive on June 27, 2014.

Criminal facts

1. Embezzlements of lost possession;

A. The Defendant, around 11:00 on January 17, 2014, found one resident registration certificate owned by C, a victim C, who was placed on the automatic sales machine of the electric railroad tickets, in the Yongsan-gu, Yongsan-gu, Seoul Metropolitan City waiting room of 23-gil 55-gil, as Yongsan-gu.

B. Around 14:00 on February 14, 2014, the Defendant embezzled the property that had been occupied by the victim on two occasions without following necessary procedures, such as acquiring a copy of the TPPPAS youth transportation card from the Seoul subway platform located within 405, the Yongsan-gu Seoul Metropolitan Government Han River, and returning it to each victims.

2. On February 2014, the Defendant used computers, etc.: (a) around the Seoul Station located in 405, as Yongsan-gu Seoul, and nearby subway stations located in Dongdaemun-gu Seoul, Seoul; and (b) over two occasions, he/she took a subway station using a copy of the TPOPAS youth transportation card acquired as described in the foregoing paragraph 1’s B to contact the terminal devices of the transportation card without authority; (b) made the victim enter information without authority in a computer or any other information processing device to process information; and (c) obtained a financial benefit of approximately KRW 2,00,000 from the Korea Railroad Corporation.

3. On January 20, 2015, the Defendant’s unlawful uttering of official documents is an official document in the same manner three times in total on the same day, including, but not limited to, the issuance of a single transportation card for senior citizens, a resident registration certificate for C of the issuance of the Gyeonggi-do high-sea market, which was acquired as described in paragraph 1(a), at the 3rd 55-lane from the Yongsan-gu Seoul Metropolitan Government Han River.
