Defendant

A Imprisonment of 10 months, Defendant B, and C shall be sentenced to 6 months of imprisonment, Defendant D and E shall be sentenced to 8 months of imprisonment, and Defendant F.

Punishment of the crime

1. Defendant A, Defendant B, and Defendant C, who are the regular director of the Victim KK located in the Gangnam-gu Armed Forces of Gangwon-gu and have overall control over the economic affairs, such as the purchase and sale of agricultural products, and Defendant B and Defendant C, who are an employee of the economic department of the above victim, while holding office as an employee of the economic department of the above victim, was in charge of purchase, sale, preparation of books

The Defendants opened an account under the name of L, a member of the victim, and prepared the relevant account books as if they purchased agricultural products from L, and conspired to transfer the money owned by the victim to the said account and use it.

On December 8, 2005, the Defendants purchased KRW 40 km from L from the above K Sales System at KRW 280,000,000, the Defendants falsely prepared and approved the purchase slips, payment resolution, etc., and remitted KRW 280,000, which was under custody for the victim to the above account in the name of L, and used the above money as the temporary entertainment expenses, etc.

The Defendants conspired and embezzled total of KRW 36,244,132 through 12 times from that time until December 28, 2007, such as the list of crimes in the annexed Table 1.

2. Defendant D, from December 15, 2009 to August 1, 2013, was in charge of the management, storage, and packing of the agricultural products purchased while serving as a technical employee of the said victim.

On June 22, 2011, the Defendant kept raw materials, such as glutinous rice 4,250 glutinous rice, purchased to sell small packages at the K Office located in the Gangnam-gu Seoul Special Metropolitan City of Gangseo-gu, and prepared a false account book as if the glutinous rice 4,250 glutinous rice were sold on credit to customers, and sold the above glutinous rice 4,250 glutinous rice 11,30,000 won to MN and used the price individually.

Accordingly, the Defendant embezzled the property stored for the victim in the course of business.

3. Defendant E is the victim from October 23, 2006 to August 10, 2009.
