A. (i) Defendant B and Defendant Korea Korea Co., Ltd. are established.

1. Basic facts

A. (i) The structure and current status of the real estate listed in the separate sheet No. 1 (hereinafter referred to as the “instant building”) are as follows: (a) the instant building was a newly constructed building around December 198; and (b) the original general building was an aggregate building on April 8, 1989; and (c) was divided into the first floor, the second floor, the third floor, the fourth floor, and the fourth floor; and (d) was registered in the collective building ledger.

⑵ 이 사건 건물 1층의 구분소유자이던 O은 1989.경 이 사건 건물 1층을 101호, 102호, 103호, 104호, 105호, 106호, 107호, 108호의 8개 점포로 분할하는 공사를 하였고, 그 후 2003.경 다시 이 사건 건물 1층의 내부수리공사가 이루어져 기존의 위 8개 점포가 102호(별지 2 도면 표시 ㅈ‘ 부분), 110호(위 도면 표시 ㅁ’, ㅌ‘ 부분), 111호(위 도면 표시 ㅂ‘ 부분), 112호(위 도면 표시 ㅋ’ 부분), 113호(위 도면 표시 ㅎ‘ 부분), 114호{위 도면 표시 {ㄹ}^{2}(위 도면 표시 83, 87, 86, 84, 83의 각 점을 순차로 연결한 선내 부분이다

Article 28(1) of the former Commercial Code provides that "a line connecting each point of the above 41, 92, and 93 in sequence among the 1st floor of the instant building and the line connecting each point of the above 35,64, 47, 88, and 87 with each point of the above 35, 64, 47, 88, and 87 is a cement brick, but the present line is a glass wall and a entrance leading each point of the above 41, 92, and 93 in sequence, on the line connecting each point of the above 41, 93 specifications."
