1. On March 25, 2012, the Defendant participated in an assembly or demonstration on March 25, 2012 by participating in an assembly or demonstration on the following grounds: (a) from March 25, 2012 to March 18:45 of the same day in Seoul Western-gu, Seoul Western-gu; (b) from 3,000 participants of other assemblies; and (c) participating in the “cirical force; (d) the destruction of the Korea-U.S. FTA; (e) the opposition to the nuclear security normal meeting; and (e) the opposition to the Jeju naval Base.”
As a result, the Defendant did not comply with the demand for voluntary dispersion from the Seoul Southern Police Station guard and the head of the Seoul Southern Police Station, who was authorized by the head of the Seoul Southern Police Station on the same day on the ground that he did not comply with the demand despite the demand for voluntary dispersion on the grounds that he did not meet the demand. 2. 2013. 2. 23.자 일반교통방해 및 집회및시위에관한법률위반 피고인은 2013. 2. 23. 14:10경 서울 남대문구에 있는 서울역광장에서 3,500여명과 함께 '2. 23. 노동자대회ㆍ범국민대회'에 참가하여 서울광장 방면으로 행진 중 소원지(訴願紙) 2,000여매와 모형 상여(喪輿)를 소각하고, 같은 날 15:45 ~ 17:35까지 서울역에서 을지로 입구 진행방향 전차로 및 을지로 사거리에서 명동 방향 전차로를 각각 점거한 채 연좌ㆍ농성하였다.
