1. The Defendant (Counterclaim Plaintiff) G is about the Plaintiff’s share of 1/19 square meters, each of which is 515 square meters in Jannam-gun, Chungcheongnam-do.

The principal lawsuit and counterclaim shall be judged together.

Basic Facts

The deceased K (Death on November 2, 2006) and the plaintiffs and non-party L are children of the deceased M (Death on July 6, 2013), and N are all the deceased M's successors as the deceased's spouse.

Defendant G’s spouse, Defendant H, I, and Nonparty O are both the children of the network K and the heir of the network K.

P was assessed on September 15, 1914, JJ 271 square meters (hereinafter “instant land”). The said land was inherited to the deceased M in an unregistered state. On April 22, 1993, the deceased K completed the registration of initial ownership of the said land in its own name.

The area of the above land was 271m2 at the time of the registration of ownership preservation on the above land was completed. The registration of ownership transfer in the name of Qand Qand Q & R & R & 9m2 on March 29, 1996 was transferred on the ground of sale on January 5, 1980, and the total area was 515m2 on the same day by combining the above land.

The defendant G completed the registration of ownership transfer on December 7, 2006 on the above land due to the inheritance due to the agreement division as of November 2, 2006.

On July 31, 2006, the deceased M completed the registration of ownership transfer on the ground of the donation made on January 2, 1994 to Defendant H on July 31, 2006.

On January 29, 2009, Defendant H completed the registration of creation of a mortgage on the above land with the maximum debt amount of KRW 52,00,000,000, and with the debtor, the above defendant, the mortgagee, and the South Sea Fisheries Cooperatives.

On July 27, 200, the deceased M obtained a fishery license in its name (hereinafter “instant fishery license”), and completed the registration of transfer on November 12, 2001, and thereafter completed the registration of transfer on November 12, 2001. After the death of the network K, Defendant H and I completed the registration of transfer on November 30, 2006 for each of 1/2 shares as inheritance.

On January 4, 2011, Defendant I traded to Defendant H on December 29, 201 with respect to 1/2 of its shares in the said fishery license.
