1. All of the instant lawsuits are dismissed.
2. The costs of the lawsuit are assessed against D who is represented by the plaintiff.
Reasons
1. Each real estate listed in the separate sheet stating the purport of the plaintiff's assertion is originally owned by the plaintiff's clan, and according to Article 29 of the Rules of the plaintiff's clan, for the disposal of the property of the plaintiff's clan, at least 50 members of the plaintiff's clan shall pass a resolution with the consent of more than a majority at the general meeting present. Therefore, since the registration completed by the Defendants in the future is null and void, the Plaintiff clan, Defendant Jeonju-si, as to each site listed in attached Tables 1 through 12, Defendant B, as to each of the forest of this case, is obligated to implement the ownership transfer registration procedure based on the restoration of each real name with respect to 1/2 shares out of each of the forest of this case, and Defendant C, as to the cancellation registration of ownership transfer registration completed with respect to 1/2 shares out of each of the forest of this case, and Defendant Korea Credit Guarantee Fund is obligated to express its consent with respect to the above transfer registration of ownership as to
2. Determination on the defense prior to the merits
A. The summary of the defendants' prior defenses ① The resolution of the general meeting of October 3, 2014 (hereinafter referred to as the "general meeting of this case") which elected D who filed the lawsuit of this case as the representative of the plaintiff clan as the chairperson of the plaintiff clan is null and void since it is serious defect in the convocation procedure of the general meeting. D is not the legitimate representative of the plaintiff clan, but the plaintiff clan, and ② the lawsuit of this case is filed without the legitimate authorization of the plaintiff clan. Thus, the lawsuit of this case is unlawful.
(b) Determination 1) Fact-finding 2, 16, and 17 (including paper numbers; hereinafter the same shall apply) are as follows:
(A) The plaintiff clan is a clan consisting of lineal descendants, who jointly set up the five-year-old descendants, and the plaintiff clan enacted on October 10, 195, by integrating the overall purport of the arguments in each entry of Eul's Nos. 1, 6, and 17 and 20.
