1. The plaintiff's appeal is all dismissed.
2. The plaintiff's primary claim against the defendant B added by this court.
Reasons
1. The plaintiff's clan is the clan of which the 12th member of G is the clan of which the Ha is the joint ancestor.
The forest land of this case was originally owned by the plaintiff clan, and the plaintiff clan has managed the forest land of this case by trusting the name of four clan members, each of two descendants in the two houses with respect to the forest land of this case.
Plaintiff
As above, on December 20, 1971, a clan held title trust of 1/4 shares out of the forest of this case with I and the deceased C. Defendant B, at will, completed the registration of ownership transfer in accordance with the Act on Special Measures for October 20, 1985, and on May 27, 2003, completed the registration of ownership transfer with respect to 1/4 shares out of the forest of this case with his own child D and E.
Therefore, with respect to each of the pertinent shares of the instant forest land, Defendant B, around the other hand, is obligated to perform the procedure for registration of cancellation of ownership transfer registration in a preliminary manner due to the completion of acquisition by reason of the cancellation of title trust, first and second preliminaryly due to the completion of acquisition by reason of the title trust, and Defendant Qua, Defendant D, Defendant E, Defendant R, Defendant U, U, V, and Defendant C, who are the heir of the network I, are obligated to perform the procedure for registration of cancellation of ownership transfer registration by reason of the cancellation of title trust according to their inheritance shares.
2. Determination on the defense prior to the merits
A. The plaintiff's assertion that the defendant's clan is a clan composed of Ha who is 12 years of age of G as a joint ancestor. But H's tomb does not exist, it does not gather a memorial, and the plaintiff's clan is a family of the 15 years of age that is the son of the J (J and M) of 14 years of age, and since the plaintiff's clan is a family of the 15 years of age that is the son of K, the plaintiff's clan cannot be viewed as a clan of its unique meaning that is the joint ancestor of H.
B. The relevant legal doctrine refers to a natural development group consisting of descendants of the majority who share the same family with the common ancestor for the purpose of protecting the graves of the common ancestor and promoting friendship among the religious members and their family members.
