Reasons
Punishment of the crime
On October 28, 2010, the Defendant was sentenced to imprisonment of one year and six months for fraud in the Seosan Branch of the Daejeon District Court on September 3, 2013 and the judgment became final and conclusive on September 3, 2013.
1. At around August 13, 2007, the Defendant: (a) the victim C was sent a false call to the victim C to the effect that “I would give money to the victim, such as the fall of a corporation in custody of D; (b) the victim would sell the fall and the spawn in custody of D; and (c) the victim received a delivery of the amount equivalent to KRW 35,329,000 at the market price of the fall and the spawn in custody of D around that time.”
As a result, the defendant acquired the victim's 35,329,000 won in a false and misleading market price.
2. On June 27, 2007, the Defendant stated that the Defendant was unable to pass the import clearance procedure upon the finding that the FF was influence of the imported goods in Busan National Fishery Products Quality Inspection Center located in Jung-gu, Busan, Busan, the Central Fishery Products Quality Inspection Center (hereinafter referred to as the “FF”) at around 27, 2007, the Defendant stated that the Defendant would return the imported goods to the Republic of Korea and return them to the Republic of Korea and seek a new abortion in the amount equivalent to USD 56,779 (Korean US$ 55,853,780) imported from China on the introduction of the Defendant.
On January 12, 2008, the Defendant arbitrarily exported the boxes of 2,473 around June 26, 2008 to Korea, and embezzled them by arbitrarily providing the remainder of 1,082 boxes with a mortgage in order to pay freezing storage fees, while receiving an amount equivalent to KRW 5,853,780 from the freezing warehouse of China, which was returned 55,853,780.
