피고인은 2012. 12. 8. 17:00경 제천시 B아파트 107동 507호에 있는 피고인의 집에서, 인터넷 사이트에 접속하여 피해자 (주)뉴스원이 게재한 C 대통령 후보자의 광화문광장 유세 장면을 취재한 사진을 다운로드받은 후 '포토샵' 프로그램을 이용하여 유세현장의 인파가 많이 모인 것처럼 조작한 다음, 인터넷 사이트인 다음 아고라의 경제토론방에 접속하여 "<속보> C 유세현장 구름인파!!!!!!!!! 10만 운집@@@"이라는 제목으로 위와 같이 조작한 사진을 사진 우측 하단에 ‘뉴스원’이라는 기재가 포함된 상태로 게재함으로써 허위사실을 유포하여 피해자의 공정한 보도 업무를 방해하였다.
