Defendant
A Imprisonment with prison labor of two years and six months, and Defendant B shall be punished by imprisonment with prison labor of two years.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. Sex trafficking of Defendant A;
A. From January 25, 2016 to January 29, 2016, Defendant A engaged in commercial sex acts by paying KRW 50,000 to the 4th floor “G”-Ma of the building located in Seo-gu Daejeon, Seo-gu, Daejeon, and allowing E (tentative name) to enter the Defendant’s sexual organ with his/her hand and rapidly engage in commercial sex acts.
B. From the end of January 2016, Defendant A engaged in sexual intercourse, such as paying KRW 50,00 at the shop site of the above “G” and allowing D (tentative name) to talk with the Defendant’s sexual organ and rapidly enter the Defendant’s sexual organ, thereby engaging in sexual intercourse.
2. The defendant B's sexual traffic;
A. From January 25, 2016 to January 29, 2016, Defendant B paid KRW 50,000 to the above “G” in the shop, and caused the said E to engage in sexual intercourse by allowing the said E to talk with the Defendant’s sexual organ and rapidly enter the Defendant, thereby engaging in sexual intercourse.
B. On January 2016, Defendant B performed commercial sex acts by paying KRW 50,00 at the shop site of the above “G”, and by allowing the said D to enter the Defendant’s sexual organ in his/her hand, and rapidly engage in commercial sex acts.
3. Mediation of sexual traffic by the Defendants
A. The Defendants conspired with H and I, from February 2, 2016 to February 2, 2016, received money from the said “G” customers, and had the said E and D perform a sexual intercourse against customers, or have them receive part of the price for sexual traffic received from customers.
Accordingly, the Defendants conspired with H and I to engage in commercial sex acts such as arranging sexual traffic.
B. The Defendants conspired with the Defendants, from March 1, 2016 to March 9, 2016, leased three rooms (101, 102, and 103) in the Seo-gu Daejeon Seo-gu J Housing, Seo-gu, Daejeon, Seo-gu, Daejeon, and leased three rooms (101, 102, and 103) to “K” and received money from the non-residents.
